GENERAL TERMS AND CONDITIONS of the portal COLLECTORNEWS.INFO
EFFECTIVE FROM: 1. 5. 2023
Article 1. INTRODUCTORY PROVISIONS
Double Impact , s.r.o., with its registered office at V Zářezu 902/4, Prague 5, Czech Republic 155 00, ID No.: 027 13 641, Tax ID No.: CZ027 13 641, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, 222747, which is engaged in advertising and marketing activities, issues these General Terms and Conditions (hereinafter referred to as “GTC”) regulating the rights and obligations of the contracting parties arising in connection with the use of the COLLECTORNEWS.INFO portal.
1. These GTC set out the terms and conditions for the use of the COLLECTORNEWS.INFO portal. By registering to the GPR, the Participant confirms his/her consent to these GPR and agrees to the processing of personal data for Double Impact , s.r.o., with registered office at V Zářezu 902/4, Prague 5, 155 00, ID No.: 027 13 641, VAT No.: CZ027 13 641, for the purpose of sending regular newsletters and other advertising and commercial communications, monitoring and evaluating the Participant’s habits and his/her satisfaction with the offered Benefits or consumer tests. The Subscriber agrees to be informed by the Provider about its services and products, or the services and products of Partners, by using the Subscriber’s postal address, the Subscriber’s e-mail address, the Subscriber’s telephone number, by means of automatic calling devices, by fax or other similar means, including telemarketing.
2. The Participant undertakes to comply with these GPR when establishing, using and terminating registration on the COLLECTORNEWS.INFO portal.
Article 2. DEFINITION OF BASIC TERMS
1. Collectornews.info is a portal through which the Participant can benefit from the Benefits offered by the Operator or the Partners of 1. Collectornews.info.
2. The Operator of the portal Collectornews.info is Double Impact , s.r.o., with registered office at V Zářezu 902/4, Prague 5, 155 00, ID No.: 027 13 641, VAT No.: CZ027 13 641, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 222747, which, on the basis of the Participant’s registration on the portal Collectornews.info, provides the Participant with the opportunity to obtain benefits from the Operator of the portal and its Partners. The Operator is a personal data controller within the meaning of Section 4(j) of the Personal Data Protection Act.
3. The Participant is a natural person who registers on the COLLECTORNEWS.INFO portal; the Participant is a data subject within the meaning of Section 4(d) of the DPA.
4. Partner means any of the partners of the COLLECTORNEWS.INFO portal, which offers Participants the opportunity to purchase its goods and/or services under discounted conditions and to benefit from other advantages specified by it.
5. 101/2000 Coll., on the protection of personal data and on the amendment of certain acts, as amended.
Article 3. Registration on the COLLECTORNEWS.INFO portal
1. Registration is voluntary. Any natural person over 15 years of age may register. Each person may register only once.
2. A necessary condition for taking advantage of the benefits of registration on the COLLECTORNEWS.INFO portal is the proper and correct registration of the Interested Party. The Interested Person shall register through the online form available on the website www.collectornews.info.
3. There is no charge for registration on the COLLECTORNEWS.INFO portal.
4. The Operator reserves the right not to register an Interested Party in the event of an incorrectly completed registration form. If the registration form is filled in correctly and confirmed, the registration on the COLLECTORNEWS.INFO portal will be completed.
Article 5. BENEFITS CONCERNING REGISTRATION ON COLLECTORNEWS.INFO
The Participant is entitled to the Benefits associated with registration on the COLLECTORNEWS.INFO portal, which are announced by the Operator for the current time period.
2. The types of Benefits depend on the current offer of the Partners of the COLLECTORNEWS.INFO PORTAL and may include, for example, discounts on the prices of goods and services at individual Partners, priority purchases, i.e. priority purchases, a wider selection of goods and services, free shipping from e-shops, etc.
3. The Operator reserves the right to change, supplement or otherwise modify the Benefits. The offer of any particular Benefit is limited in duration. After this period, the right to use the Benefit expires. The current list of Benefits, their validity and the list of Partners with whom Benefits can be redeemed is available on the COLLECTORNEWS.INFO portal. The Operator reserves the right to make the use of certain Benefits subject to the fulfilment of predefined conditions, which will always be specified for a particular Benefit. All information about the Benefits, the conditions of their application and their duration will be provided on the website www.collectornews.info.
4. The Operator shall not be liable for any damage caused to the Participant by unannounced changes to the offer by the Partners, which result in the impossibility of using the Benefits associated with registration on the COLLECTORNEWS.INFO portal. The Operator shall not be liable for any damage to the Participant’s health and property caused by the use of the Benefits by the Partners.
5. The Operator reserves the right to register, without notice and without any compensation, a Participant who uses the Benefits of registration on the COLLECTORNEWS.INFO portal in violation of good morals, the laws in force and in force in the EU. The Operator also reserves the right to register, without notice and without any compensation, a Participant who, by his/her actions, endangers the reputation of the Operator or the goods and/or services of the Partners.
6. The Operator may announce a competition and/or a lottery within the COLLECTORNEWS.INFO portal, which may be participated in by a Participant who meets the conditions set out for participation in this competition/lottery, specified in more detail in the specific rules of the competition/lottery.
Article 7. CANCELLATION OF REGISTRATION ON COLLECTORNEWS.INFO PORTAL
1. The Participant may cancel his/her registration on the COLLECTORNEWS.INFO portal at any time.
2. The Operator reserves the right to cancel the COLLECTORNEWS.INFO portal without giving any reason. From the date of the termination of the COLLECTORNEWS.INFO portal, it will no longer be possible to take advantage of the Benefits.
3. Registration on the COLLECTORNEWS.INFO portal will cease:
1. by delivery of a written request of the Participant to cancel the registration to Double Impact , s.r.o., with registered office at V Zářezu 902/4, Prague 5, 155 00.
2. a serious breach of these GPR has occurred;
3. the Participant has misused the registration, logo, portal name or other identifying data or in any way damaged the rights and legitimate interests of the Operator;
4. the moment of discovering that the Participant has misused the registration on the COLLECTORNEWS.INFO portal for his/her own benefit or for the benefit of another person, in particular by using it for his/her own or a third party’s business purposes;
5. the moment of withdrawal of the Participant’s consent to the processing of personal data;
6. and in other cases provided for in these GPR.
4. registration on the COLLECTORNEWS.INFO portal shall cease:
1. death of the Participant;
2. the moment of discovering that the Participant has provided intentionally false information in the registration form;
3. the moment of cancellation of the COLLECTORNEWS.INFO portal;
4. and in other cases as set out in these GPR.
5. Upon termination of registration on the COLLECTORNEWS.INFO portal, the Participant shall lose the right to benefit from the Benefits arising from registration on the COLLECTORNEWS.INFO portal.
6. Termination of the Participant’s registration on the COLLECTORNEWS.INFO portal does not affect the Operator’s right to send the Participant further commercial communications.
Article 8. PROTECTION OF PERSONAL DATA
1. The Operator processes the personal data of all Participants in accordance with legal regulations, in particular Act No. 101/2000 Coll., on the protection of personal data, as amended, and Act No. 480/2004 Coll., on certain information society services, as amended. The operator has taken measures to secure personal data within the meaning of Section 13 of the Personal Data Protection Act and ensures compliance with the duty of confidentiality and other ethical rules when working with personal data.
2. By registering the Participant, the Participant’s personal data will be processed in connection with this registration for the purposes to which the Participant consents. By clicking on the relevant button to register the Participant on the COLLECTORNEWS.INFO portal, the Participant voluntarily consents to the processing of his/her personal data for the purposes of registration.
3. For the purposes of these GPR, the Participant’s personal data will be processed in the following scope: name, surname, home address, email address, frequency of visits to the Operator’s Partner, the Participant’s responses recorded through surveys and/or tests, the amount of spending at the Operator’s Partner, the segment classification at the Operator’s Partner, information on transactions carried out by the Participant in the Operator’s computer system and in the computer systems of the Partners and information on the Participant’s activity and behaviour on www.www.collectornews.info as well as on social networks (Facebook, Twitter, Instagram).
4. Consent to the processing of personal data for the purposes under these GPR is granted for the period of the Participant’s registration on COLLECTORNEWS.INFO. Upon termination of registration, the processing of the Participant’s personal data for all purposes for which the Participant has given consent will be terminated.
5. The Participant may at any time exercise his/her rights pursuant to § 11, § 12 and § 21 of the CPR. In particular, the Participant is entitled to withdraw his/her consent at any time free of charge, to request access to personal data, to request correction of incorrect or outdated personal data, to request completion of incomplete personal data, to request blocking, termination of processing of his/her personal data and/or its destruction, to request information on the processing of his/her personal data, etc. If the Participant discovers or believes that his/her personal data is being processed in violation of the protection of his/her private and personal life or in violation of the law, the Participant may request an explanation and/or the elimination of the defective situation. The Participant may also initiate administrative proceedings with the Data Protection Authority in relation to the protection of personal data.
6. If the Participant registers (enters) in a competition organised by the Operator, his/her personal data will be processed in connection with his/her participation in this competition for the purposes to which the Participant consents. By clicking on the relevant button used to register the Participant for the competition, the Participant voluntarily consents to the processing of his/her personal data for the purposes of participation in the competition (i.e. e.g. creation of the Participant’s profile, evaluation of the competition results, etc.).
7. The Participant’s personal data will be processed for the purposes of participation in the Competition and, where applicable, for other purposes to which the Participant consents, in the scope of name, surname, residential address, e-mail address, contact telephone number, birth number and/or date of birth, place of birth, nationality, ID number, password, gender, highest educational level.
8. Consent to the processing of personal data for the purposes of participation in the competition is granted for a period of 5 years from the end of the competition. Consent for any other purposes to which the Participant consents via the registration (entry) form is granted for the period of the Participant’s registration on COLLECTORNEWS.INFO.
9. In the event that the Participant receives a prize in the Competition, the Participant grants the Operator, at the same time as granting consent to the processing of personal data for the purposes of participation in the Competition, consent to the publication of his/her name and surname on the Website of the Competition, on the Website www.www.collectornews.info or on the Operator’s promotional materials, as well as consent to the publication of his/her likeness (e.g. photograph during the prize-giving, etc.) on the Website www.www.collectornews.info , the Website of the Competition and the Operator’s promotional materials.
10. The Participant acknowledges and agrees that the Operator is entitled to transfer the Participant’s personal data to another administrator who is entitled to manage and process such personal data to the same extent as the Operator, for the same period of time as the Operator and for the same purposes as the Operator.
Article 9. OTHER ARRANGEMENTS
1. By submitting the Online Registration Form, the Participant accepts without reservation all provisions of the GPR as in force and effect on the date of submission of the Online Registration Form.
2. The Operator reserves the right to change or amend the GPR at any time without prior written notice to individual Participants separately. All changes and/or additions to the GPR will be announced on the website www.www.sberatel.info and reflected in the GPR. The current version of the GPR is available on the website www.collectornews.info. If a Participant does not agree to any changes or additions, the Participant may terminate his/her membership at any time in accordance with these GPR.
3. Marketing communications of the COLLECTORNEWS.INFO portal sent to the Participant by the Operator, including marketing communications of individual Benefits by the Operator, shall be deemed to be communications within the COLLECTORNEWS.INFO portal.
4. All requests, suggestions or complaints of the Participants shall be received by the Operator at the postal address below or at info@sberatel.info.
5. The state supervisory authority to which the Operator’s business activities are subject is the Czech Trade Inspection Authority, Inspectorate for Central Bohemia and Prague, Štěpánská 567/15, Prague 2, 120 00
Article 10. OUT-OF-COURT DISPUTE RESOLUTION
1. In the event of a dispute between the Participant and the Operator that cannot be resolved by mutual agreement, the Participant may submit a proposal for out-of-court settlement of such dispute to the following consumer dispute resolution body:

2. The Participant may also use the online dispute resolution platform set up by the European Commission at http://ec.europa.eu/consumers/odr/.
Article 11. FINAL PROVISIONS
1. The Operator shall deal with the Participant in the Czech language in all contractual relations during the term of the contractual relationship.
2. The contractual relationship between the Operator and the Participant shall be governed by the law of the Czech Republic and any disputes arising from such legal relationship shall be resolved by Czech courts.
3. These GPR shall come into force and effect on 1 May 2023.
